End User License Agreement

1. Definitions

Licensor
Means a company ActiveDev Wojciech Horzowski which provides a License for the software known under the name Wojdav Bootstrap Mvc.
The Software, Library, Wojdav Bootstrap Mvc Library, Wojdav Bootstrap Mvc, Wojdav Bootstrap Mvc Package
Means a set of DLL files and accompanying them other files that constitute a part of the following projects: Wojdav Boostrap Mvc, Wojdav Boostrap Mvc Asp Net Mvc Core, Wojdav Boostrap Mvc Asp Net Mvc 5, Wojdav Boostrap Mvc Core, WHtmlParser and WQuery.

Licensee
Means a person or a company which accepts terms and conditions of this Agreement

User
Means a person that uses the software

Non-Commercial Project
Means a project which does not bring directly or indirectly any financial profits.

Commercial License
Means a kind of license after buying which a software can be used for commercial purposes.

2. User Consent

By downloading, opening and/or using some components of or all software you agree that the End User License Agreement (EULA) is a legally binding and valid contract and you give consent to conclude this agreement. The Licensee is obliged to respect the law as well as all terms of this License Agreement.
By downloading, opening and/or using the software without buying one of the commercial licenses, the user is a subject to the terms ad conditions of a free license.
If you do not agree to conclude the agreement, please remove all components of the software from your computer.

3. Terms of the License

In this point there are described terms and conditions for particular licenses.

3.1 All licenses
The Licensee may use the software for unlimited period of time.
The Licensee may use the software in unlimited number of projects.
The Licensee is not allowed to sell, give, lend, lease or distribute the License. The only exception is a Company License that may be resold.

3.1.1 Free License
The Licensee can use the software only in non-commercial projects.

3.1.2 Personal License
The Licensee may use the software for commercial purposes.
The License shall be purchased only by individual people.
The License shall not be purchased by a company or an organization.
The software may be used only by the Licensee.
The License shall not be resold.

3.1.3 Small Company License
The Licensee may use the software for commercial purposes.
The License shall be purchased only by companies or organizations employing fewer than 5 people.
One License entitles to use the software at only one place of work.
The License shall not be resold.

3.1.4 Company License
The Licensee may use the software for commercial purposes.
The License shall be purchased by companies or organizations.
One License entitles to use the software at only one place of work.
The License shall be resold.

4. General terms

4.1 Important terms
The License Agreement is a legally binding contract between the Licensor and the Licensee.
The software is a property of the Licensor. The software is licensed, not sold.
Using the software for commercial purposes is limited by a number of purchased licenses. One license shall be purchased for each user or a place of work if an organization is considered. People or organizations that do not have a commercial license are not allowed to use the software for commercial purposes.
If the Licensee does not meet the requirements of this Agreement, the License for using the software shall terminate immediately.
Subject to the terms and conditions of this Agreement, the Licensor grants a limited, non-exclusive and non-transferable license with no possibility to sublicense for using the software. The Licensor does not transfer the rights to the name of software.

4.2 Other terms
The License is granted for an indefinite period of time.
The Licensee can make copies of the software for archival purposes in any quantity. Other users are not allowed to use these copies for comercial purposes.
The Licensee is not entitled to modify, reverse-engineer, disassemble, decompile and create derived works from the software or its components.
The Licensor reserves the right to change the price, specification, availability of the software as well as can stop providing technical support at any time.

4.3 The law
This Agreement shall be governed by the law of Poland. All disputes arising in connection with this Agreement shall be submitted to the Polish courts.
If any provision of the Agreement is found invalid or against the law, the remaining provisions of this Agreement shall continue in full force and effect.
The User will use the software in compliance with the law. It is forbidden to use the software for unlawful purposes.
The software is protected by the copyright law.

4.4 Termination
The Licensee may terminate this Agreement at any time. It is not required to inform the Licensor. However, the Licensee is obliged to immediately destroy all copies of the software. After termination of this Agreement, the Licensee cannot claim reimbursement of the costs of purchasing the software. The financial obligations incurred by the User shall survive the termination of this License.

4.5 Warranty
The Licensor provides no warranties, express or implied, on the software including its efficiency, usability and reliability.

5. Disclaimer of warranty

The software is provided to the Licensee "as is" without warranties. The Licensor provides no warranties, express or implied, as to performance, reliability, efficiency, product support services and merchantability of the software. It concerns all files of the software.

6. Disclaimer of damages

In no event will the Licensor be liable to the Licensee and/or any User of software for any damages arising out of the use of the software. It concerns any direct, consequential, indirect, incidental, special damages, damages for loss of profits, business interruption, loss of information or data (confidential or non-confidential) and all financial or non-financial damages arising out of the use, inability to use the softwre, or lack of or inadequate software support services.

Before purchasing the commercial license, the software can be downloaded and tested for free.
