License Agreement for Automation TestKit

This License Agreement ("Agreement") is entered into between us ("Licensor") and the user ("Licensee") who has purchased a valid license for the TestKit ("Library") developed and provided by the Licensor. This Agreement governs the terms and conditions under which the Licensee may use the Library.

Grant of License:
Licensor hereby grants Licensee a non-exclusive, worldwide, royalty-free license to use the Library for both commercial and non-commercial purposes, subject to the conditions set forth in this Agreement and upon the Licensee purchasing a valid license for the Library.

Permitted Use:
Licensee is permitted to use the Library solely for the purpose of integrating it into their own software projects, applications, or products. This includes but is not limited to development, testing, deployment, and distribution.

Restrictions:
Licensee shall not, under any circumstances:
a) Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code of the Library.
b) Modify, alter, adapt, enhance, or create derivative works based on the Library.
c) Distribute or sublicense the Library, in whole or in part, in any form or manner, including but not limited to selling, leasing, or renting.

Intellectual Property Rights:
The Library, including all related intellectual property rights, is and shall remain the sole property of the Licensor. Licensee acknowledges that this Agreement does not transfer any ownership rights or copyrights to the Licensee.

No Warranty:
The Library is provided "as is" without any warranty, expressed or implied, including but not limited to the warranties of merchantability, fitness for a particular purpose, and non-infringement. Licensor shall not be liable for any damages, including but not limited to direct, indirect, incidental, special, or consequential damages, arising out of or in connection with the use or performance of the Library.

Termination:
Licensor reserves the right to terminate this Agreement and the license granted herein at any time, without prior notice, if the Licensee breaches any provision of this Agreement. Upon termination, Licensee shall immediately cease all use of the Library and destroy any copies in their possession.

Governing Law:
This Agreement shall be governed by and construed in accordance with the laws of Victoria, Australia. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Victoria, Australia.

Entire Agreement:
This Agreement constitutes the entire agreement between the Licensor and Licensee concerning the subject matter hereof and supersedes all prior or contemporaneous oral or written agreements, understandings, or representations.

By using the Library, Licensee acknowledges that they have read and understood this Agreement and agree to be bound by its terms and conditions.
